We understand that purchasing machinery represents a significant investment. Therefore, we seek to offer fair, transparent, and reasonable solutions when situations arise that affect the provision of service.

Our goal is to maintain a trusting relationship with each client, always acting with professionalism and good faith.

At HORÓMETRO INSPECTIONS GROUP LLC we are committed to providing our services in a professional, transparent, and efficient manner.

This Refund and Cancellation Policy establishes the conditions applicable to cancellations, rescheduling, inability to perform an inspection, and possible refunds or credits related to our services.

By hiring our services, the client accepts the conditions described below.

1. Scheduling the inspection

An inspection will be scheduled once the following requirements are met, as applicable:

  • Confirmation of availability from HORÓMETRO INSPECTIONS GROUP LLC.

  • Receipt of the corresponding payment (unless otherwise agreed in writing).

  • Sufficient information about the location and characteristics of the equipment.

  • Confirmation of availability of the machinery.

  • Confirmation of access to the machinery by the seller, owner, or operator, when possible.

Prior confirmation of access constitutes informed authorization by the seller or owner, but does not guarantee that access will actually be permitted at the time of the visit.

HORÓMETRO INSPECTIONS GROUP LLC does not control the subsequent decisions of the seller, owner, operator, or responsible party at the location.

2. Cancellation by the client

The client may request the cancellation of the service before the inspection has been performed.

When the cancellation request is received before HORÓMETRO INSPECTIONS GROUP LLC has initiated effective coordination of the visit with the seller or has incurred expenses related to the provision of the service, the client may request a refund of the amount paid.

In these cases, only the following may be deducted:

  • Reasonable administrative expenses.

  • Non-recoverable payment processing fees.

  • Other costs actually incurred and directly related to the request.

If the inspection has already been coordinated, scheduled, or travel, coordination, or preparation expenses have been incurred, the corresponding charges for the costs actually incurred may apply.

3. Rescheduling of the inspection

If the client needs to change the date of the inspection, HORÓMETRO INSPECTIONS GROUP LLC will do its best to accommodate the request, provided there is availability and the seller, owner, or operator can also reschedule the visit.

Change requests should be made as far in advance as possible.

A rescheduling will incur no cost when it can be done without generating additional expenses.

If the date change generates additional travel, coordination, booking, or other directly related expenses, such costs may be communicated and charged to the client before the new visit is made.

4. Cancellation or obstruction by the seller or owner

If the seller, owner, operator, or person responsible for the location:

  • denies access to the equipment;

  • cancels the visit;

  • informs that the machinery has already been sold;

  • removes or relocates the machinery;

  • prevents the agreed-upon tests from being conducted;

  • imposes restrictions that prevent the completion of the inspection;

  • presents a different machine than originally reported;

  • or the inspection cannot be carried out for reasons attributable to the seller,

HORÓMETRO INSPECTIONS GROUP LLC will inform the client as soon as possible.

When this situation occurs before our staff has traveled to the location, we will seek to agree with the client on one of the following alternatives:

  • Reschedule the inspection.

  • Use the balance to inspect another machine within our coverage.

  • Issue a credit for a future inspection.

  • Make a refund, deducting only the expenses actually incurred, when applicable.

5. Access denied after the trip

When HORÓMETRO INSPECTIONS GROUP LLC has sent inspection personnel to the agreed location and the seller, owner, operator, or responsible party of the location:

  • completely denies access to the machinery;

  • prevents the inspection from being carried out;

  • removes or relocates the machinery;

  • does not allow the previously agreed tests to be conducted;

  • or imposes restrictions that make it impossible to complete the inspection,

the situation will be documented as Access denied or Restricted access, as applicable.

In these cases, when the inability to conduct the inspection is attributable to the seller, owner, operator, or responsible party of the equipment, the following mechanism will apply:

50% of the service value

The 50% of the inspection value will be retained by HORÓMETRO INSPECTIONS GROUP LLC as compensation for the costs and resources already committed, including, among others:

  • Inspector travel.

  • Staff time.

  • Prior coordination.

  • Inspection preparation.

  • Transportation.

  • Tolls.

  • Parking.

  • Administrative expenses.

  • Other operating costs directly related to the visit.

50 % as credit

The remaining 50 % will be granted to the client as credit for a future inspection.

This credit may be used to hire a new inspection with HORÓMETRO INSPECTIONS GROUP LLC.

The credit will be valid for 12 months from the date of the original visit.

If the new inspection is valued higher than the available credit, the client must pay the difference.

The credit cannot be converted to cash or transferred to third parties, except with the express written authorization of HORÓMETRO INSPECTIONS GROUP LLC.

This mechanism seeks to provide a fair solution to the client without transferring to HORÓMETRO INSPECTIONS GROUP LLC the total costs incurred by a situation that is outside of its control.

6. Partially completed inspection

If the inspector is able to access the equipment but cannot complete certain procedures due to restrictions imposed by the seller, owner, operator, or responsible party at the site, the inspection may be conducted partially.

In this case:

  • The tests that could be performed will be documented.

  • The limitations encountered will be clearly indicated.

  • The report will identify the items that could not be verified.

  • The service will be considered executed based on the scope actually performed.

When applicable, HORÓMETRO INSPECTIONS GROUP LLC may use expressions such as:

“Inspection partially completed – Restricted access”.

Access limitations will not automatically result in a refund, unless HORÓMETRO INSPECTIONS GROUP LLC determines in writing that the part of the service actually performed does not meet the minimum contracted scope.

7. Inability to perform the inspection due to circumstances beyond HORÓMETRO's control

If our inspector travels to the agreed location and the inspection cannot be performed due to circumstances beyond HORÓMETRO INSPECTIONS GROUP LLC's control, reasonable expenses already incurred may be deducted from the amount paid.

These may include:

  • Travel.

  • Transportation.

  • Tolls.

  • Parking.

  • Coordination expenses.

  • Staff time.

  • Other costs directly related to the visit.

When applicable, the procedure established in section 5 will use the mechanism of 50% withheld and 50% as credit.

HORÓMETRO INSPECTIONS GROUP LLC will strive to inform the client transparently about the circumstances that prevented the inspection from being conducted.

8. Replacement or change of machinery

The client is responsible for providing correct information about the equipment they wish to inspect.

If the seller presents a machine different from the one originally indicated, or if the originally identified machine is no longer available, HORÓMETRO INSPECTIONS GROUP LLC may:

  • Request confirmation from the client before conducting a new inspection.

  • Conduct the inspection of the new machine if it falls within the scope and coverage of the contracted service.

  • Reschedule the inspection.

  • Request a new quote when there are significant differences in location, characteristics, scope, or costs.

The inspection performed on one machine cannot be automatically considered valid for another different machine.

9. Changes made after the inspection

The inspection documents the conditions observed on the date and time of the visit.

Once the inspection is completed, HORÓMETRO INSPECTIONS GROUP LLC does not maintain control over the machinery.

The seller, owner, or operator may subsequently:

  • Repair the machine.

  • Replace components.

  • Modify systems.

  • Use the equipment.

  • Transport it.

  • Damage it.

  • Alter its conditions.

  • Replace it with another equipment.

Therefore, no return or claim can be based on changes that occurred after the inspection that were not observed and documented during the visit.

10. Pre-loading verification

The initial inspection does not automatically include the verification of the machine before loading.

If the client wishes to confirm that the machine to be loaded corresponds to the same machine that HORÓMETRO INSPECTIONS GROUP LLC inspected previously, they must hire the additional service of Pre-loading verification.

This service may include:

  • Verification of the serial number.

  • Verification of make and model.

  • Verification of the hour meter.

  • Comparison of photographs.

  • Comparison of physical characteristics.

  • Verification of the inspection code.

  • Visual review of evident changes or modifications.

  • Updated photographic record.

The hiring of this service provides an additional verification of identity and condition, but does not constitute an absolute guarantee against hidden modifications or changes that cannot be detected through a visual inspection.

11. Loading supervision

The Loading supervision is an additional and independent service from the initial inspection.

When contracted, HORÓMETRO INSPECTIONS GROUP LLC may supervise the loading process in person according to the scope established in the quotation.

The service may include:

  • Verification of the equipment's identity.

  • Photographic record.

  • Documentation of the loading process.

  • Visual verification of the equipment's condition before loading.

  • Record of the final position of the equipment.

  • Photographic evidence of the process.

Loading supervision does not constitute a guarantee regarding:

  • Subsequent damage during transport.

  • Subsequent handling.

  • Conditions of maritime or land transport.

  • Transport safety.

  • Damage occurring after the equipment leaves the loading site.

12. Identification of machinery

During the inspection, HORÓMETRO INSPECTIONS GROUP LLC may record the elements that allow for the identification of the equipment, including:

  • Serial number.

  • Brand.

  • Model.

  • Hour meter.

  • Engine number.

  • Particular physical characteristics.

  • Detailed photographs.

  • Unique inspection code.

When there is express authorization from the owner or responsible party of the equipment, a label, sticker, or inspection identification element may be placed.

Such identification has solely a documentary and traceability purpose.

It does not constitute a guarantee that the equipment will remain unchanged after the inspection.

13. Force Majeure

HORÓMETRO INSPECTIONS GROUP LLC will not be responsible for delays or cancellations caused by circumstances beyond its reasonable control, including, but not limited to:

  • extreme weather conditions;

  • government restrictions;

  • Road closures.

  • health emergencies;

  • labor conflicts;

  • natural disasters;

  • widespread transportation failures;

  • Access restrictions.

  • Safety situations.

  • Other unforeseen or unavoidable circumstances.

In these cases, we will work with the client to reschedule the service or find a reasonable solution.

14. Delivery of the report

Once the inspection has been carried out and the technical report has been delivered to the client, the service will be considered executed.

As this is a professional service based on technical observations made in the field, no refunds will be issued once the service has been completed and the report has been delivered, unless HORÓMETRO INSPECTIONS GROUP LLC expressly determines otherwise.

The delivery of the report does not constitute a guarantee regarding the future operation of the machinery or any changes after the inspection.

15. Refund requests

Refund requests must be made in writing through the official channels of HORÓMETRO INSPECTIONS GROUP LLC.

The request must indicate:

  • Customer name.

  • request or inspection number;

  • Service date, when applicable.

  • reason for the request.

  • Additional information that allows for case evaluation.

Each request will be evaluated according to this policy and the current Terms and Conditions.

HORÓMETRO INSPECTIONS GROUP LLC will strive to respond to requests within a reasonable timeframe.

16. Means and timeframe for return

When a refund is applicable, it will be processed using the same payment method used by the customer, unless both parties agree to another method.

The accreditation times will depend on the financial institution, payment platform, or provider used.

Non-recoverable payment processing fees may be deducted from the amount to be refunded when applicable.

17. Relationship with the Terms and Conditions

This Refund and Cancellation Policy is part of the general conditions for the provision of services by HORÓMETRO INSPECTIONS GROUP LLC.

It should be interpreted together with the Terms and Conditions of Use and Service Provision, the quote accepted by the client, and any specific agreement made in writing.

In the event that there is a specific condition established in writing in a quote or individual contract, that condition may prevail over the general conditions, provided it has been expressly accepted by both parties.
